Saskatchewan invites 150 candidates to apply for Express Entry and Occupations In-Demand streams

Minimum Saskatchewan Expression of Interest score rises four points to 78

Saskatchewan held two draws through the Express Entry and Occupation In-Demand immigration sub-categories issuing a total of 150 invitations.

The Saskatchewan Immigrant Nominee Program (SINP) uses a unique Expression of Interest (EOI) points grid to rank candidates in its Saskatchewan Express Entry and Occupations In-Demand sub-categories.

The break down for Saskatchewan’s August 15 provincial nomination draws are as follows:

  • 45 Express Entry
  • 105 Occupations In-Demand

Candidates had to have a minimum Saskatchewan Expression of Interest score of 78.

Candidates receive a score out of 100 based on factors including their education, skilled work experience, proficiency in English or French and connections to Saskatchewan. The highest-scoring candidates in both sub-categories are then invited through regular draws from the pool.

Express Entry

Saskatchewan’s Express Entry stream is linked to the federal Express Entry system. Candidates who are already in the Express Entry pool and who meet the requirements to succeed in Saskatchewan may be selected for a provincial nomination.

Express Entry candidates with a provincial nomination receive an additional 600 points toward their Comprehensive Ranking System (CRS) score. Given that most federal draws require CRS scores over 400, a provincial nomination practically guarantees an invitation to apply for Canadian permanent residence.

Occupations In-Demand

Candidates eligible for the Occupation In-Demand sub-category who receive a provincial nomination have their applications for Canadian permanent residence processed outside the Express Entry system.

Though a job offer is not required for this sub-category, a key eligibility requirement for both the Express Entry and Occupations In-Demand sub-categories is to have experience in one of the 19 occupations currently listed as in-demand in Saskatchewan.

The SINP has issued 1,789 invitations through its Occupation In-Demand sub-category, and 1,315 through its Express Entry sub-category so far in 2019.

The number of invitations issued in the August 15 draw (150) shows a marked decrease from the previous draw on July 24, which saw 381 invitations issued.

PEI conducts new draw for Express Entry, Labour and Business candidates

Prince Edward Island has issued new invitations to apply for a provincial nomination to candidates in its Express Entry, Labour Impact and Business Impact categories.

The province’s Office of Immigration issued a total of 116 invitations to Express Entry and Labour Impact Category candidates and eight to candidates in its Business Impact Category.

The minimum score for Business Impact Category candidates was 152. PEI’s Office of Immigration did not provide a minimum score for the Labour Impact and Express Entry invitations.

Express Entry candidates who wish to be considered under the PEI Express Entry Category must create a profile in the province’s Expression of Interest system. Profiles are reviewed and assigned points based on six selection factors: age, language, education, work experience, employment, and adaptability.

Express Entry candidates who have been invited through the PEI Express Entry Stream have 90 days from the invitation date to submit a complete application to the province’s Office of Immigration. Applicants who are nominated by PEI receive an additional 600 Comprehensive Ranking System (CRS) points, leaving them well position to receive an Invitation to Apply for Canadian permanent residence.

PEI’s Labour Impact Category is for individuals who possess skills and experience that are needed in PEI’s labour market. The category is divided into three streams: Skilled Workers, Critical Workers and International Graduates.

Controversial business streams now closed

The Government of Prince Edward Island announced last week that the September 20 draw would be the final invitation round for the Business Impact Category’s 100% Ownership and Partial Ownership streams, which had become mired in controversy.

The streams allowed candidates to be nominated for permanent residence by PEI in exchange for opening a business in the province. Investigations revealed, however, that many never opened a business after receiving permanent residence status.

Prince Edward Island says it will maintain the Business Impact Category’s Work Permit Stream, which issues immigrant entrepreneurs with a temporary work permit to start their business and only nominates them for Canadian permanent residence once the terms of their performance agreement are met.

Quebec Skilled Worker Program’s Arrima portal is now open

The new online portal for the Quebec Skilled Worker Program, known as Arrima, is now in service.

Effective today, candidates who are interested in obtaining Canadian permanent residence through the Quebec Skilled Worker Program (QSWP) can express their interest to the Government of Quebec by creating a profile using Arrima.

The Government of Quebec switched to an Expression of Interest (EOI) system for the QSWP in August. The EOI system requires all interested candidates to create a profile and provide the requested information on their education, an area of training, proficiency in French and other languages and work experience, among other details.

Quebec’s Immigration Ministry, MIDI, says it will issue invitations to “those who meet certain criteria, focusing mainly on labor market needs in the different regions of Quebec.”

Anyone issued an invitation will then be able to apply to the Government of Quebec for a Quebec Selection Certificate (Certificat de séléction du Québec, or CSQ).

Once a Quebec Selection Certificate is awarded, individuals can submit a complete Canadian permanent residence application to Canada’s federal government.

Eligibility

Unlike the QSWP’s previous first-come, first-served model, there is no cap on the number of candidates who can enter the QSWP bank.

In order to submit a profile, the only requirement is to be at least 18 years of age.

However, in order to be eligible for selection, candidates will have to meet passing scores for employability and selection factors in accordance with the QSWP points grid.

MIDI has provided only limited information on how individuals will be ranked in the QSWP bank of candidates. It has indicated there will be a ranking system, but it is not known if it will be similar to the federal Express Entry system‘s Comprehensive Ranking System, or CRS.

How Arrima works

Users enter a virtual waiting room, where they wait until notified of their turn to access the portal.

Once access is granted, users will have 90 minutes in the portal. MIDI recommends saving frequently in order to avoid losing the information submitted up to that point in the event one’s 90-minute session expires.

Registrants have 30 days to complete their profile, which will remain valid for one year.

Candidates in the EOI pool can update their profile with new information or revise the information provided at any time during the 12-month validity period.

Those invited by Quebec to apply for a Quebec Selection Certificate have 90 days to submit a complete application.

4 Common Mistakes When Applying for a Labour Market Opinion

Canadian employers looking to hire Temporary Foreign Workers must first receive government permission to hire from abroad. In most cases, this permission comes in the form of a Labour Market Opinion (LMO).

An LMO is a document issued by Human Resources and Skills Development Canada (HRSDC) stating that the hiring of a foreign worker will have a positive or neutral effect on the Canadian labor market. Temporary foreign workers must receive an LMO in order to receive a temporary work permit unless specifically permitted to bypass this requirement. In order to receive a positive LMO, Canadian employers must submit an application where they successfully demonstrate that no Canadian citizen or permanent resident could be found to fill the desired position in Canada. The time period for preparing an application and receiving an LMO generally takes at least three months.

Because every employment situation is unique, no two LMO applications will be exactly the same. The complexity inherent in preparing such an individualized application means that refusals can happen for mistakes as simple as clerical errors. Below are four common mistakes employers make when applying for an LMO – and what can be done to avoid them:

1. Insufficient Recruitment in Canada: In almost all LMO applications, the Canadian employer must first recruit for the open position in Canada. Recently, HRSDC raised the minimum recruitment period from 2 weeks to a full 4 weeks. In most cases, HRSDC mandates that recruitment take place on the government jobs website (www.jobbank.gc.ca, or an equivalent provincial site). In addition, the employer is now, in most cases, required to advertise in two additional venues. Recruitment must be completed within three months of an LMO application submission. Additional rules apply to individuals looking to hire semi- and low-skilled workers.

An LMO application will be refused if recruitment standards are not met. To mitigate this, when possible employers should recruit for a period of time longer than the minimum amount required. They should also be aware that some positions may be advertising exempt. Many advertising exemptions vary from province to province.

2. Failure to Meet Wage and Job Requirements: Foreign workers in Canada are afforded the same job standards as their Canadian counterparts. The LMO application process serves, in part, as a way to ensure that these standards are upheld. The application asks employers to provide information on the wages, benefits, and general working conditions of the job being offered.

Employers must indicate that they will be paying their foreign worker a salary equal to or greater than the prevailing wage for their occupation. If they fail to do this or to meet Federal and Provincial job standards, the application will be refused. Employers should thoroughly research the salary standards for the job position.

3. Incomplete or Inaccurate Application: It goes without saying that the LMO application form should be filled out and checked for both completion and accuracy.

When preparing an application, employers should address the following questions:

  • Am I applying for the right approval? Does this job require an LMO, is it LMO-exempt, is it advertising exempt?
  • Am I able to provide all necessary papers on my business, if requested?
  • Am I prepared to speak with an HRSDC official about the job and desired employee, if they choose to call? If an employer cannot be reached, HRSDC may refuse an application.

4. Cannot Convince Officer of Need for a Foreign Worker: A positive LMO will not be issued if the officer reviewing the file believes that the hiring of a foreign worker will take a job away from qualified Canadians. This may happen if the requirements for the specified job are too broad, or the skills needed to perform job tasks are not particularly specialized, and therefore easy to fill.

When conducting recruitment in Canada, employers should be sure to carefully construct their advertisements to reflect the specific skills needed for the position. They should be aware that requiring competency in a language other than English or French is only allowed if the employer can demonstrate that knowledge of the language is essential. Providing a report of recruitment efforts and responses from interested candidates will strengthen one’s argument.

Ontario May Revise the Minimum CRS Score Rule for OINP- Express Entry HCP Stream

As per the latest news reports, the minimum CRS score requirement will now be determined by the Director.

Moreover, candidates have been suggested to show interest in ‘immigrating to Ontario’ or select the option of “all provinces and territories” when registering their profile in federal express entry system.
